A jury detemined last week that a plaintiff failed to prove negligence against the driver of a bus owned by G&I client, the Rochester-Genesee Regional Transportation Authority, so that the plaintiff's lawsuit was dismissed (Carter v. R-GRTA, Index No. 12258/01, Justice Robert J. Lunn, Supreme Court, Monroe County). The Plaintiff, a passenger on a RTS bus, claimed that the bus driver turned suddenly causing her to fall and sustain injury. Trial attorney, Seema Ali, stated that "there were questions as to whether the incident ever occurred and the jury's verdict tends to suggest serious doubts concerning the Plaintiff's credibility." The jury's verdict is, however, subject to review by Justice Lunn by way of various applications made by the Plaintiff's attorneys during and after the Trial.
