Joseph B. Rizzo successfully obtained an Order today remanding a lawsuit to New York State Court. G&I clients, Susan and Guy Brown, commenced state court litigation against DePuy AcroMed, Inc. ("AcroMed") and Genesee Hospital alleging that Mrs. Brown sustained severe personal injuries due to defective pedicle screws, manufactured by AcroMed, which had been surgically implanted on Mrs. Brown's spine. AcroMed removed the lawsuit to federal court. In Brown v. DePuy AcroMed, Inc., et ano., United States District Judge David Larimer held that the federal district court lacked jurisdiction over the case and sent the lawsuit back to New York State Court.
